NOTICE OF PROPOSED ADOPTION OF THE SECOND AMENDMENT TO THE DECLARATION OF CONDOMINIUM FOR BASE 9 CONDOMINIUMS To: All First Mortgagees of Condominium Units in Base 9 Condominiums Dated: May 17, 2019 The Base 9 Condominiums Homeowners Association (the "Association") hereby gives notice to all First Mortgagees of Condominium Units in Base 9 Condominiums that the Association is proposing the adoption of the Second Amendment to the Declaration of Condominium for Base 9 Condominiums (the "Proposed Amendment'). The Proposed Amendment will amend the Declaration of Condominium for Base 9 Condominiums recorded December 31, 1979 at Reception No. 201516 of the Summit County records, which has been amended and supplemented by Amendment to Declaration of Condominium for Base 9 Condominiums recorded October 6, 1980 at Reception No. 212883 (collectively, the "Declaration"). A copy of the Proposed Amendment is available from the Association's legal counsel, Willis & Connelly, PC, c/o Michael Connelly, Esq., PO Box 1639, Breckenridge, Colorado 80424. Pursuant to the Declaration and C.R.S. §38-33.3-217(1)(b), the Proposed Amendment requires the affirmative vote of First Mortgagees which may be provided to the Association's legal counsel at the address listed above.
